This has got to be the ultimate in frivolous lawsuits. No lawyer or judge in their right mine should take this on. It should be thrown right out of court. It is so ridiculous that all of us have to pay for idiots like this. Eating in the specialty restaurants is a "choice". I'm sure she would have had no problem getting into the regular dining venues which are included in the cruise fare. This is the kind of case where the judge needs to rip it up the moment court is called into session, throw the pieces in the air, make the plaintiffs and their lawyer pick up the floor, and then tell the plaintiff they owe NCL for legal fees and for being a general pain-in-the-***.

In addition to a fuel sur-charge we may have legal fee sur-charges next to pay for the idiots in society who have nothing better to do than play the "sue somebody lottery". The biggest shame is not only do corporation have to hire legal teams to defend against frivolous lawsuits, they sometime are settled out of court, paying these people off for being idiots. Sometimes they even win such goofy cases. The McDonalds case of coffee too hot comes to mind. Hence all the silly warning lables like, "This is shampoo, don't ingest it!"
Just a point- somewhere I read or heard on the radio that in the McDonald's case it didn't wind up with anything being paid but it probably cost McDonald's some hefty lawyer fees never the less.
All of you previous posters should be ashamed of yourselves! This woman has a legitimate complaint and you guys are minimizing her suffering. It's not fair for you people to pass judgment on a situation that you were not there to witness. I am embarassed for all of you. P.S. Now is the time that I should mention that my wife deals with people with mental disorders. People like this give my wife job security so I fully support her lunacy!

Good point. I'm sure anyone who cruised with NCL could claim they were denied a table. Of course the case has to be certified as a class-action suit by the court.
The thing is, the court can require, if they find merit to the case, that NCL provide a complete list of all potential passengers back to the date allowed by the Statute of limitation where the case is filed. In some cases they order the defendant to pay for the notification process of all involved and even public notification (newspapers and other media) to post the details for those who have moved or can no longer be reached. I hope a judge will see the frivolous nature of this and not allow such measures. Can you even imagine the cost of the time, paperwork, mailing expense, legal fees and other costs just to notify everyone who has sailed NCL over the past couple of years just to let them know they have the right to join such a case? Now you know why so many cases are settled out of court for rediculous amounts to avoid an actual trial. But even then the notifications are often still needed to get the settlement in the hands of those who can prove they were affected. Is it any wonder the cost of daily life keeps rising? I don't know the actual numbers but a good percentage of just about everything we buy has a built in cost factor for possible litigation. New products being introduced and things that have inherent risk like sports equipment or motorcycles have a higher percentage. We're now much safer from the products we buy, unless we buy imports from China. Now we just need ways of being safer from the lawyers and the people who love to sue over anything!
Sounds like a cry baby to me...14 cruises with NCL and never had a problem getting a reservation if I wanted on...and most of the time I don't want one....I didn't get a deck chair by the pool the last time I was on the Pearl because I think all the balcony people had them....should I sue?.....Happy sailing to real cruising people....you take the good with the bad....Nuff said...
